1. Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and StoutGrowth ("we," "us" or "our"), concerning your access to and use of the stoutgrowth.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

By accessing the Site or using our Services, you agree that you have read, understood, and agree to be bound by all of these Terms of Use. If you do not agree with all of these terms, then you are expressly prohibited from using the Site and you must discontinue use immediately.

2. Intellectual Property Rights

Unless otherwise indicated, the Site and our "Growth Operating System" (including source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics) are our proprietary property and are protected by copyright and trademark laws.

3. User Representations

By using the Site, you represent and warrant that:

- All registration information you submit will be true, accurate, current, and complete.

- You will maintain the accuracy of such information.

- You are not a minor in the jurisdiction in which you reside.

- You will not access the Site through automated or non-human means, whether through a bot, script, or otherwise.

- You will not use the Site for any illegal or unauthorized purpose.

4. Fees and Payment

Accepted Methods:
We accept the following forms of payment: Visa, Mastercard, American Express, and Discover (via Stripe). You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site.

You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.

Billing Cycles (Monthly & Annual):

Monthly Subscriptions: By selecting a monthly plan, you authorize StoutGrowth to charge your payment method on a recurring monthly basis until you cancel.

Annual Subscriptions: By selecting an annual plan, you authorize StoutGrowth to charge your payment method annually. Annual plans are billed upfront and are non-refundable, even if cancelled mid-term.

No Refunds / All Sales Final:
Due to the nature of our services—which involve significant upfront time allocation, intellectual property deployment, and software provisioning—all sales are final.

No Refunds: StoutGrowth does not offer refunds for any partial months, unused services, or regret-based cancellations. Once a payment is processed, it is earned by StoutGrowth.

Setup Fees: Any setup fees or "onboarding" fees paid are non-refundable under any circumstances, as they cover labor and costs already incurred.

Chargeback Policy:
You agree to contact us directly to resolve any billing disputes. You hereby agree not to initiate any chargeback or dispute with your credit card issuer or bank.

- If you initiate a chargeback which is subsequently decided in our favor, you agree to reimburse StoutGrowth for all costs incurred in defending the chargeback, including but not limited to bank fees, legal fees, and administrative time.

- StoutGrowth reserves the right to immediately terminate the account and blacklist any client who initiates a chargeback.

Discounts & Free Trials:
From time to time, we may offer special discounts, promotional pricing, or free trials. These are offered at the sole discretion of StoutGrowth and may be revoked or modified at any time without notice.

Trials: If you sign up for a free trial, you will be automatically charged the standard subscription rate at the end of the trial period unless you cancel prior to the expiration date. It is your responsibility to track your trial expiration.

Cancellation:
You may cancel your subscription at any time by logging into your account portal or emailing [email protected]

Effect of Cancellation: Your cancellation will take effect at the end of the current paid term. You will retain access to the system until that date.

Data Retention: Upon cancellation, your account, website, and phone numbers will be deactivated. It is your responsibility to export your leads and customer data prior to your final cancellation date. We are not responsible for data lost after an account is closed.
